Regulation 42 of the Environmental Impact Assessment Regulations, 2014, as amended (EIA Regulations) provides for the opening and maintenance of a register of interested and affected parties (I&APs), by the proponent or applicant, which must contain personal information (names, contact details and addresses). It is therefore the duty of Minds Alike Consultants to collect the information that must be contained in the register and comments must be included in the EIA report.
Minds Alike Consultants in adherence to POPIA requirements will not include nor make available in the public domain these registers in reports. Minds Alike Consultants will not divulge other than as required in Regulation 42 EIA Regulations any personal information to any other 3rd parties.
Section 12(2)(b) Protection Of Private Information Act (POPIA) - By registering as an I&AP you agree to your personal information collected are being used for the purposes of the Environmental Impact Assessment as described above.
Section 11(1)(a) & 11(1)(c) POPIA - By registering and commenting you acknowledge that your name and comments will be used by the decision-making body (Competent Authority) and be used in the published reports. In accordance to Section11(1)(c) you have the right to opt not to have your name and any other personal data shared in the report. Minds Alike Consultants only publish in its report the I&AP name (optional) and listed comments. Processing of names and comments as part of the EIA regulated process is required as defined in the EIA Regulations, it must be emphasised that withholding personal names associated to the comment could impact the Competent Authority in making informed decisions in terms of verifying comment with I&AP registered database and to communicate report releases and critical decisions during the EIA process.
